DECISION & ORDER ON MOTION

Motion by the law guardian for the subject child in the above-entitled proceeding, inter alia, for leave to appeal to this court from an order of the Family Court, Kings County, dated October 5, 2006, and to stay the enforcement of the order pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the motion is otherwise denied as academic.
