It is Ordered that the motion is granted only to the extent of continuing the stay of the fee hearing in the trial court, to and including December 13, 2006. If, by said date, the appeal has been perfected, then the appellant may move for a further continuation of the stay. Otherwise, the attorney's fee hearing may proceed in the trial court anytime after December 13, 2006. The conditional stay will not be continued unless the appeal has been perfected. [see 22 NYCRR § 640.6]
