It is Ordered that the motion to vacate the stay is denied, without prejudice to renew in the event the appellant fails to comply with any of the conditions of the November 6, 2006 order of this court. Upon non-compliance with said order, the petitioner may move on five days' notice for an order vacating the conditional stay in this illegal activity hold-over proceeding. The court notes that the amount of the judgment [$ 2,042.24] and the October and November use and occupancy has to be tendered to the petitioner by November 20, 2006, if it has not already been paid.
