DECISION & ORDER ON MOTION

Motion by the respondent to enlarge the time to serve and file a brief in response to the supplemental pro se brief on an appeal from a judgment of the Supreme Court, Suffolk County, rendered October 28, 2004, and cross motion by the appellant pro se for leave to reargue his motion for leave to serve and file an appendix to his supplemental brief, which was determined by decision and order on motion of this court dated September 28, 2006.

Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition to the cross motion, it is

ORDERED that the motion is granted, the respondent's time to serve and file a brief in response to the supplemental brief is enlarged until December 12, 2006, and the respondent's brief in response to the supplemental brief must be served and filed on or before that date; and it is further,

ORDERED that the cross motion is denied.
