Motion by the appellant for leave to prosecute an appeal from an order of the Family Court, Queens County, dated August 3, 2006, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied, with leave to renew on or before December 8, 2006, upon proof that the appellant is receiving public assistance.
