| DECISION & ORDER ON MOTION |
Appeal by the defendant from an order of the Supreme Court, Queens County, dated February 2, 2006. By decision and order on motion of this court dated June 22, 2006, the appellant's motion to stay all proceedings in the above-entitled action was granted on condition that the appeal was perfected on or before August 7, 2006. The appeal has not been perfected.
Now, on the court's own motion, it is
ORDERED that the stay granted by decision and order on motion of this court dated June 22, 2006, is vacated forthwith.
