DECISION & ORDER ON MOTION

Appeals by permission from two orders of Supreme Court, Queens County, both dated July 27, 2006. By decision and order on motion dated September 8, 2006, this court stayed the inquest on damages in the above-entitled action on condition that the appeals were perfected by October 10, 2006. The appeals have not been perfected and the appellant has not sought any additional time to perfect the appeals.

Now, on the court's own motion, it is

ORDERED that the stay granted by the decision and order on motion dated September 8, 2006, is vacated forthwith for failure to perfect the appeals in accordance with the decision and order on motion dated September 8, 2006.
