DECISION

Application by appellant for a writ of error coram nobis to vacate an order entered June 2, 2004 dismissing the appeal and to reverse the judgment of the City Court of Yonkers, Westchester County (M. Martinelli, J.), rendered November 13, 2001, convicting him, upon his plea of guilty, of assault in the third degree is granted to the extent that the order entered June 2, 2004, dismissing the appeal is vacated, appeal reinstated and the time to perfect the appeal is enlarged to February 2, 2007.

Assigned counsel, Loren Glassman, Esq., is directed to communicate with the incarcerated defendant concerning his desire, if any, to perfect the appeal.
