Motion by the respondent on an appeal from a judgment of the Supreme Court, Suffolk County, dated December 7, 2005, to dismiss the appeal on the grounds, inter alia, that the record is inadequate. Application by the respondent to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and application, and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the application is granted and the respondent's time to serve and file a brief is enlarged until December 28, 2006, and the respondent's brief must be served and filed on or before that date.
