DECISION & ORDER ON MOTION

Motion by the respondent, inter alia, to dismiss an appeal from an order of the Supreme Court, Kings County, dated February 10, 2006, on the ground that the People's delay in obtaining the order dated February 10, 2006, has denied the respondent his right to a speedy trial.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
