It is Ordered that the motion is granted to the extent of continuing the stay of the re-letting of the premises, to and including January 11, 2007. If, by said date, the appeal has been perfected and the appellant has tendered the December and January "rent" to the petitioner, without prejudice, then the appellant may move for a continuation of the stay. Otherwise, the apartment may be re-let after said date.
