DECISION & ORDER ON MOTION

Motion by the respondents for a preference in the calendaring of an appeal from an order of the Supreme Court, Westchester County, entered October 12, 2006, and, in effect, to direct the appellant to perfect the appeal by a date certain and for a briefing schedule.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is, in effect, to direct the appellant to perfect the appeal by a date certain and for a briefing schedule is granted and the appellant's record or appendix and brief shall be served and filed on or before February 1, 2007, the respondents shall file their brief, if any, on or before March 1, 2007, and the appellant shall serve and file its reply brief, if any, on or before March 12, 2007; and it is further,

ORDERED that the branch of the motion which is for a preference in the calendaring of the appeal is granted and the appeal shall be calendared when fully perfected.
