DECISION & ORDER ON MOTION

Appeal by Fitzroy Bennett from a judgment of the County Court, Rockland County, rendered January 15, 2003. By order to show cause dated October 27, 2006, the appellant was directed to show cause why an order should or should not be made and entered dismissing the appeal as abandoned (see CPL 460.70[2][c]; 22 NYCRR 670.8[f]).

On the court's own motion, and no papers having been filed in response to the order to show cause, it is

ORDERED that the appeal is dismissed, without costs or disbursements, as abandoned (see 22 NYCRR 670.8[f]).
