DECISION & ORDER ON MOTION

Motion by Vaios Tsoukas, president of 83-17 Broadway Corp., on an appeal from an order of the Supreme Court, Queens County, dated May 5, 2005, to dismiss the appeal and, in effect, to enlarge the time of 83-17 Broadway Corp. to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is dismissed, on the ground that 83-17 Broadway Corp. must appear by an attorney (see CPLR 321).
