DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, to stay all adoption proceedings for the subject child pending hearing and determination of an appeal from an order of the Family Court, Suffolk County, entered June 1, 2006, cross motion by the Law Guardian to dismiss the appeal on the ground that the appeal was untimely taken, and separate motion by the appellant to extend the time to file the notice of appeal, in the event that it is determined that the notice of appeal was untimely filed.

Upon the papers filed in support of the motions and the cross motion, and the papers filed in opposition thereto, it is

ORDERED that the motion, inter alia, to stay all adoption proceedings for the subject child pending hearing and determination of the appeal is granted to the extent that finalization of the adoption is stayed pending hearing and determination of the appeal and that motion is otherwise denied; and it is further,

ORDERED that the cross motion is denied; and it is further,

ORDERED that the separate motion to extend the time to file the notice of appeal, is denied as academic.
