DECISION & ORDER ON MOTION

Motion by the respondents-appellants Sambasiva Rao Venigalla, Kattinger V. Rao, Anand Mohan, Venkaiah Dama, and Nehru E. Cherukupalli on an appeal and cross appeals from an order and judgment (one paper) of the Supreme Court, Queens County, dated March 23, 2006, to dismiss the appeal on the ground that the appellants-respondents are not aggrieved by the order and judgment dated March 23, 2006, and separate motion by the respondent-appellant Krishnamurthy Aiyer to dismiss the appeal on the ground that the appellants-respondents lack standing.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the motions are denied; and it is further,

ORDERED that on the court's own motion, the time to perfect the appeal is enlarged until January 25, 2007, and the joint record or appendix on the appeal and the appellants-respondents' brief must be served and filed on or before that date; and it is further,

ORDERED that the respondents-appellants Sambasiva Rao Venigalla, Kattinger V. Rao, Anand Mohan, Venkaiah Dama, and Nehru E. Cherukupalli and the respondent-appellant Krishnamurthy Aiyer shall serve and file their respective answering briefs, including points of argument on the cross appeals, in accordance with the rules of this court (see 22 NYCRR 670.8[c][3]).
