| DECISION & ORDER ON APPLICATION |
Application by the appellant on an appeal from an order of the Supreme Court, Kings County, dated October 11, 2005, to substitute Edward B, Loeb, Jr., in place of Edward Loeb, Sr., as administrator of the estate of Gerda Eisenstein Loeb, and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is
ORDERED that the application is granted and Edward B, Loeb, Jr., is substituted in place of Edward Loeb, Sr., as administrator of the estate of Gerda Eisenstein Loeb, and the caption has been amended accordingly; and it is further,
ORDERED that the appellant's time to perfect the appeal is enlarged until February 13, 2007, and the record or appendix on appeal and the appellant's brief shall be served and filed on or before that date.
