Motion by the petitioner to enlarge the time to prosecute a proceeding pursuant to CPLR article 78 which was transferred to this court by order of the Supreme Court, Dutchess County, dated October 18, 2005.

ORDERED that the motion is denied as academic as the appeal was timely perfected on November 1, 2006.
