| DECISION & ORDER ON APPLICATION |
Application by the appellants City of New Rochelle and New Rochelle Police Department pursuant to 22 NYCRR 670.8(d)(2) to withdraw their appeal from an order of the Supreme Court, Westchester County, dated March 31, 2003.
Upon the stipulation of the appellant and the respondent dated October 11, 2006, it is
ORDERED that the application is granted and the appeal by the City of New Rochelle and the New Rochelle Police Department is deemed withdrawn, without costs or disbursements; and it is further,
ORDERED that on the court's own motion the appeals by Alfred E. Chambers and Jorge W. Bedoya are dismissed, without costs or disbursements, for failure to timely perfect the same.
