| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, to waive the filing fees on appeals from three orders of the Supreme Court, Kings County, dated December 23, 2004, October 27, 2004, and June 16, 2005, and an order and judgment (one paper) of the same court dated October 10, 2003.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that on the court's own motion, the appeal from the order dated December 23, 2004 (Appellate Division Docket No. 2006-08761), is dismissed, without costs or disbursements, on the ground that no appeal lies as of right from an order which does not decide a motion made on notice, and we decline to grant leave to appeal (see CPLR 5701); and it is further,
ORDERED that the motion is denied.
