DECISION & ORDER ON MOTION

Motion by the respondent to enlarge the time to serve and file a brief on an appeal from a judgment of the County Court, Suffolk County, rendered June 22, 2004, and to unseal the minutes of in camera proceedings which occurred before the County Court, Suffolk County, on May 3, 2004, May 7, 2004, and May 17, 2004.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that on the court's own motion, the clerk of the trial court is directed to file copies of the transcript of the minutes of in camera proceedings which occurred May 3, 2004, May 7, 2004, and May 17, 2004, with the Clerk of this court, under seal expeditiously; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until February 16, 2007, and the respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied; and it is further,

ORDERED that the Clerk of this court, or his designee, shall serve a copy of the decision and order on motion on the Clerk in the County Court, Suffolk County.
