| DECISION & ORDER ON MOTION |
Appeal by Thurman Brown from a judgment of the County Court, Nassau County, rendered April 26, 1993. By order to show cause dated October 19, 2006, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal as abandoned (see CPL 460.70[2][c]; 22 NYCRR 670.8[f]). Motion by the appellant pro se for leave to prosecute the appeal as a poor person and for the assignment of counsel.
Upon the order to show cause and the papers filed in response thereto, and the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the order to show cause to dismiss the appeal is granted and the appeal is dismissed; and it is further,
ORDERED that the motion for leave to prosecute the appeal as a poor person and for the assignment of counsel is denied.
