| DECISION & ORDER ON MOTION |
Motion by the appellant to substitute Robert Didio, Esq., as counsel for the purpose, among other things, of making a motion for leave to appeal to the Court of Appeals from a decision and order of this court dated October 3, 2006, which determined an appeal from a judgment of the Supreme Court, Queens County, rendered March 24, 2004.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, and Robert Didio, Esq., is substituted as counsel for the appellant.
