The above-named defendant, Anthony Baldini, submits an application to this court for an order pursuant to the Criminal Procedure Law Section 460.50
releasing the defendant on his own recognizance of fixing a reasonable bail and
staying the execution of the sentence of incarceration pending the determination of
the appeal. Counsel of the defendant advised the Court and the District
Attorney's Office was notified of the instant application and have decided to take
no position on it.
Now upon the reading and filing of the affirmation of Defendant's counsel, Kenneth Aronson, Esq. dated dec. 20, 2006 , and after oral argument on the same and upon the notice of appeal annexed to said application and due deliberation had thereon; it is hereby
ORDERED, that said motion be and same is hereby granted for the stay of
execution of judgment and sentence pending the determination of the appeal to the
Appellate Term, and bail for the release of the defendant is hereby fixed in the
amount of $1,000.00 cash; and it is further
ORDERED, that upon posting the cash bail and upon approval of the same by
this court, the defendant, Anthony Baldini, shall be released from the custody of
the Sheriff of Nassau County; and it is further
