Motion by the respondent for leave to renew his prior motion to hold in abeyance an appeal from a judgment of the Supreme Court, Queens County, rendered September 21, 2001, pending determination of a motion before the Supreme Court, Queens County, of the appellant's motion pursuant to CPL 440.10, which was determined by decision and order on motion of this court dated November 1, 2006.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
