DECISION & ORDER ON MOTION

Motion by Nathan Gurewich for leave to appeal to this court from a judgment of the Supreme Court, Queens County, dated November 8, 2006, and to stay enforcement of stated portions of the judgment pending the hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied as unnecessary (see CPLR 5701[a][1]); and it is further,
