DECISION & ORDER ON MOTION

Motion by the appellant, in effect, for leave to raise an argument for the first time in a reply brief on an appeal from a judgment of the Supreme Court, Queens County, rendered May 19, 2005.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that on or before February 5, 2007, the respondent, if they be so advised, may serve and file a supplemental brief in response to the argument raised in Point III D of the reply brief.
