DECISION & ORDER ON MOTION

Appeal by Hugues Content from an order of the Supreme Court, Kings County, dated May 12, 2006. By order on certification dated July 18, 2006, an attorney was assigned as counsel to represent the appellant on the appeal. By letter dated December 5, 2006, assigned counsel notified the court that he has been unable to contact the appellant. By order to show cause dated December 11, 2006, the parties or their attorneys were directed to show cause why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding.

Now on the court's own motion, and no papers having been filed in opposition or relation thereto, it is

ORDERED that the attorney Laura Solinger is relieved of the assignment to represent the appellant on the appeal in the above-entitled proceeding; and it is further,

ORDERED that the appeal is dismissed, without costs or disbursements.
