Motion by the respondent-appellant on an appeal and cross appeal from an order of the Supreme Court, Suffolk County, entered October 24, 2006, to substitute Esther Vider, executor of the estate of Sal Vider, for the deceased defendant Sal Vider.
Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is
ORDERED that the application is granted and Esther Vider, executor of the estate of Sal Vider, is substituted for the deceased defendant Sal Vider, and the caption has been amended accordingly.
