DECISION & ORDER ON MOTION

Motion by the appellant for leave to prosecute an appeal from an order of the Supreme Court, Kings County, entered March 8, 2006, on the original papers and to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to prosecute the appeal on the original papers is denied without prejudice to making a new motion for the same relief, upon proper papers, including an affidavit setting forth the appellant's full financial situation including all assets, both real and personal, as well as any and all sources of income and any expenses; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is granted, the appellant's time to perfect the appeal is enlarged until March 12, 2007, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date.
