ORDER TO SHOW CAUSE

Motion by the respondent to dismiss an appeal from an order of disposition of the Family Court, Richmond County, dated March 24, 2006, on the ground that the order of disposition was entered upon the default of the appealing party.

Upon the papers filed in support of the motion and the papers filed in opposition and relation thereto, it is

ORDERED that the motion is denied without prejudice to the respondent raising the issue in its brief; and it is further,

ORDERED that, on the court's own motion, the appellant and the other parties to this appeal or their counsel to show cause before this court, why an order should or should not be made and entered dismissing the appeal as abandoned by each filing an affirmation or affidavit on the issue with the Clerk of this court on or before February 26, 2007; and it is further,

ORDERED that the Clerk of this court, or his designee, is directed to serve a copy of this order upon the appellant and the other parties, including the Law Guardian, if any, to these appeals, or their counsel, by regular mail.
