DECISION & ORDER ON MOTION

Motion by the appellant for a preference in the calendaring of appeals from two orders of the Supreme Court, Kings County, dated January 3, 2006, and March 2, 2006, respectively, and a judgment of the same court dated April 14, 2006, and to strike footnote 2 on pages 10 and 11 of the appellant's brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for a preference in the calendaring of the appeals is granted; and it is further,

ORDERED that the branch of the motion which is to strike footnote 2 on pages 10 and 11 of the appellant's brief is referred to the panel of justices hearing the appeal for determination upon the argument or submission thereof.
