DECISION & ORDER ON MOTION

Appeal by the defendant from a judgment of the County Court, Rockland County, rendered August 30, 2005. By decision and order on motion dated August 8, 2006, we granted that branch of the respondent's motion which was to hold the appeal in abeyance pending the determination by the County Court, Rockland County, of the defendant's motion pursuant to CPL article 440. The respondent has advised the court that the defendant's CPL 440 motion has been denied.

Now, on the court's own motion, it is

ORDERED that the respondent's time to serve and file a brief is enlarged until March 16, 2007, and the respondent's brief must be served and filed on or before that date.
