It is Ordered that the motion to re-instate the stay is denied, without prejudice to renew upon proper service of the moving papers on the adversary. Service of the moving papers must be made by any person not a party to the proceeding, who is eighteen years of age or older. (see CPLR § 2103[a]). The court notes that the appeal has yet to be perfected despite numerous court orders, dating back to June 9, 2006, requiring its prompt perfection.
