| DECISION & ORDER ON MOTION |
Appeal by Rakim I. Paulin from a judgment of the County Court, Dutchess County, rendered December 23, 1997. The appeal has not been perfected. By order to show cause dated January 10, 2007, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal as abandoned (see CPL 460.70[2][c]; 22 NYCRR 670.8[f]).
Upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion is granted and the appeal is dismissed.
