DECISION & ORDER ON MOTION

Motion by the respondent in a proceeding pursuant to EDPL 207 for a preference in calendaring the proceeding and, in effect, for a briefing schedule and cross motion by the petitioners to enlarge the time to perfect the proceeding.

Upon the papers filed in support of the motion and the cross motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for a preference is denied as unnecessary (see EDPL 207[b]); and it is further,

ORDERED that the branch of the motion which is to set a briefing schedule is denied; and it is further,

ORDERED that the cross motion is denied.
