DECISION & ORDER ON MOTION

Appeal by Lance Authelet from an order of the Family Court, Suffolk County, dated January 30, 2004. By order to show cause dated January 29, 2007, the parties were directed to show cause why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding on the ground that the appeal was untimely taken (see Family Ct Act § 1113).

Now, on the court's own motion and the papers filed in response to the order to show cause, it is

ORDERED that the order to show cause to dismiss the appeal is denied; and it is further,

ORDERED that the matter is referred to the Clerk of this court for the issuance of a scheduling order pursuant to 22 NYCRR 670.4(a)(2).
