It is Ordered that the appellant's third motion to re-instate the stay is denied. As previously stated in the prior order of this Court, the appellant has yet to perfect the appeal or to timely pay accruing use and occupancy, as required by the numerous orders of this Court, dating back to October 19, 2005. The cross-motion to vacate the stay is denied as academic. There is no stay in effect for this Court to vacate.
