| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, in effect, to stay enforcement of a judgment of the Supreme Court, Kings County, dated October 24, 2006, pending hearing and determination of an appeal from a decision of the same court dated September 22, 2006.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the court's own motion, the notice of appeal from the decision is deemed to be a notice of appeal from the judgment (see CPLR 5512); and it is further,
ORDERED that the motion is denied.
