Motion by the respondents Anthony Moralishvili and M/G Architects on appeals from two orders of the Supreme Court, Queens County, dated September 8, 2006 (Appellate Division Docket No. 2006-10242), and October 13, 2006 (Appellate Division Docket No. 2007-01757), respectively, to dismiss the appeal from the order dated September 8, 2006.
Upon the papers filed in support of the motion and the papers filed opposition thereto, it is
ORDERED that the motion is granted and the appeal from the order dated September 8, 2006 (Appellate Division Docket No. 2006-10242), is dismissed, without costs or disbursements, as that appeal has been rendered academic by the order dated October 13, 2006, which recalled and vacated the order dated September 8, 2006.
