Motion by the appellant on an appeal from a decree of the Surrogate's Court, Queens County, dated August 1, 2006, to waive the requirements of 22 NYCRR 670.10.2(f) regarding certification of the record on appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that the motion is denied as unnecessary as the appellant was given leave to prosecute the appeal on the original papers, which have been filed with the Clerk of this court.
