DECISION & ORDER ON MOTION

Appeal by Jonte L. Hatcher from a judgment of the County Court, Orange County, rendered June 21, 2001. The appeal has not been perfected. By order to show cause dated October 5, 2006, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal as abandoned (see CPL 460.70[2][c]; 22 NYCRR 670.8[f]).

Upon the order to show cause and no papers having been filed in opposition or relation thereto, it is

ORDERED that the order to show cause to dismiss the appeal is granted, and the appeal is dismissed as abandoned (see CPL 460.70[2][c]; 22 NYCRR 670.8[f]).
