(Index No. 8818/05)

DECISION & ORDER ON MOTION

Motion by the appellant on appeals from three orders of the Supreme Court, Kings County, one dated October 17, 2006, and two dated November 6, 2006, for leave to appeal to this court from the above-referenced orders and, inter alia, to stay the sale of the marital residence pending hearing and determination of the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal to this court from the order dated October 17, 2006, is denied to the extent that the order directed a hearing and that branch of the motion is otherwise denied as unnecessary as the remaining portions of the order are appealable as of right (see CPLR 5701); and it is further,

ORDERED that the branches of the motion which are for leave to appeal to this court from the orders dated November 6, 2006, are denied; and it is further,

ORDERED that the branch of the motion which is, inter alia, to stay the sale of the marital residence is denied.
