Motion by the appellant on an appeal from an order of the Supreme Court, Orange County, dated February 17, 2007, to enjoin the respondent Planning Board of the Town of Beekman from taking any further action on an application for site plan and special use approval filed by the respondent Stop & Shop Supermarket Company, LLC, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
