Appeal by the defendant from a judgment of the County Court, Nassau County, rendered October 5, 2006.
On the court's own motion it is
ORDERED that the appeal pending under Appellate Division Docket No. 2007-00780 is dismissed, without costs or disbursements, as that appeal is a duplicate of the appeal pending under Appellate Division Docket No. 2007-00222; and it is further,
ORDERED that the decision and order on motion of this court dated February 28, 2007, issued under Appellate Division Docket No. 2007-00780, is recalled and vacated, as that decision and order on motion has been rendered academic by the dismissal of that appeal.
