DECISION & ORDER ON MOTION

Appeal by Catharine S. from an order of the Family Court, Kings County, dated December 15, 2006. By decision and order on motion dated February 5, 2007, the parties were directed to show cause before this court why the appeal should or should not be dismissed on the ground that the order is not appealable as of right and leave to appeal has not been granted (see Family Ct Act § 1112). Application by the appellant for leave to appeal from the order.

Upon the order to show cause and the papers filed in response thereto, and upon the application, it is

ORDERED that the application is denied; and it is further,

ORDERED that the order to show cause to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements (see Family Ct Act § 1112).
