DECISION & ORDER ON MOTION

Appeal by the defendant from a judgment of the Supreme Court, Kings County, rendered September 16, 1999. By decision and order on motion dated November 30, 2006, the appellant's motion for leave to prosecute the appeal as a poor person, and for the assignment of counsel was denied with leave to renew on or before January 15, 2007. The appellant has not renewed his motion or perfected the appeal. By order to show cause dated February 1, 2007, the appellant was directed to show cause before this court, why an order should or should not be entered dismissing the appeal as abandoned (see 22 NYCRR 670.8[f]).

Upon the court's own motion, and no papers having been filed in response thereto, it is

ORDERED that the order to show cause is granted, and the appeal is dismissed (see 22 NYCRR 670.8[f]).
