DECISION & ORDER ON MOTION

Motion by Warren S. Hecht, Esq., counsel assigned to prosecute an appeal from an order of the Supreme Court, Queens County, dated May 31, 2006, which determined a motion made pursuant to Ch 643, L 2005, inter alia, to withdraw as counsel. By order to show cause dated February 8, 2007, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal on the ground that the appeal has been abandoned and the motion by assigned counsel to withdraw as counsel was held in abeyance in the interim.

Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the order to show cause to dismiss the appeal is granted, and the appeal is dismissed; and it is further,

ORDERED that the motion is granted and counsel is relieved.
