DECISION & ORDER ON MOTION

Motion by Kent Mosten, Esq., the attorney assigned to represent the appellant on an appeal from an order of the Family Court, Nassau County, dated October 20, 2006, to be relieved on the ground that the appellant has abandoned the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that on the motion is granted; and it is further,

ORDERED that on the court's own motion, the appeal is dismissed, without costs or disbursements, on the ground that the appellant has abandoned the appeal.
