It is Ordered that the motion is granted only to the extent of dismissing the appeal for failure to diligently prosecute unless it is perfected by the September 2007 term of this court - the filing deadline is July 9, 2007. No further extension of time will be granted. In the event a Clerk's Return is not obtained by July 9, 2007, the appeal is deemed dismissed, without further order of this Court. The cross-motion is denied as academic.
